RentLynk is a property management platform owned and operated by RentLynk Property Management , a company registered in Kenya under registration number 46641212121 , with its registered address at Delta Corner Annex, Ring Rd Westlands Ln, Westlands, Nairobi, Kenya.

By accessing or using the RentLynk website, mobile application, or services (collectively, "the Platform"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, please do not use the Platform.

1. Definitions

"Platform"

RentLynk website, mobile app, and all related services

"Landlord"

Property owner or manager using the Platform to collect rent and manage properties

"Tenant"

Renter using the Platform to pay rent, request maintenance, or communicate with Landlord

"User"

Any person accessing or using the Platform (Landlord or Tenant)

"M-Pesa"

Safaricom's mobile money service and any integrated payment partners

"Content"

Any data, text, photos, documents, or information uploaded to the Platform

2. Eligibility

You must be at least 18 years old to use RentLynk. By using the Platform, you confirm that:

  • You have the legal capacity to enter into binding agreements under Kenyan law.
  • You are not prohibited from using such services under any Kenyan or international law.
  • All information you provide is truthful, accurate, and complete.

3. Account Registration

  • You must create an account to access core features (payments, maintenance requests, etc.).
  • You are responsible for keeping your login credentials confidential.
  • You are liable for all activities that occur under your account.
  • Notify us immediately at support@rentlynk.co.ke if you suspect unauthorized access.

4. Services Provided

RentLynk offers the following core services:

  • Automated Pay-ins – Collection of rent via M-Pesa, cards, and mobile money
  • Instant Withdrawals – Transfer of funds to your bank or mobile wallet
  • Lipa Mdogo Rent – Instalment-based rent payments
  • Maintenance Hub – Reporting and tracking of repair requests
  • Smart Alerts – Automated payment reminders via SMS/email
  • Smart Analytics Dashboard – Financial reporting and insights
  • Easy Onboarding – Digital checklists and document collection
  • Multi-Property Portfolio View – Management of multiple units from one dashboard

We reserve the right to modify, suspend, or discontinue any feature with reasonable notice.

5. Payments & Fees

5.1 Transaction Fees

RentLynk charges a service fee on certain transactions (e.g., rent collection, instant withdrawals). Fees will be clearly displayed before you confirm any transaction.

5.2 M-Pesa & Payment Partner Charges

Any fees charged by M-Pesa, banks, or other payment providers are separate and are your responsibility.

5.3 No Hidden Fees

All applicable fees are disclosed upfront. We do not charge hidden or retroactive fees.

5.4 Refund Policy

Rent collected via the Platform is transferred to Landlords per their instructions. RentLynk is not responsible for disputes between Landlords and Tenants regarding rent amounts, late fees, or refunds.

6. Lipa Mdogo Rent (Instalments)

  • Tenants may deposit any amount toward their rent at any time.
  • Funds sit in a tenant wallet until the full rent is accumulated, then tenant can transfer to the Landlord to settle any utility or rent invoice.
  • Landlords receive the full rent amount on the agreed due date (or earlier if tenant completes payments early & decides to make payment).
  • RentLynk is not a lending institution. We do not advance funds or guarantee tenant payments.

7. User Conduct

You agree NOT to:

  • Use the Platform for any illegal purpose under Kenyan law.
  • Attempt to hack, bypass, or disrupt the Platform's security or functionality.
  • Upload false, misleading, or fraudulent information.
  • Harass, threaten, or abuse other users (including tenants or landlords).
  • Use the Platform to launder money or conduct fraudulent transactions.

Violation may result in immediate account suspension and referral to relevant Kenyan authorities (e.g., DCI, Communications Authority of Kenya).

8. Data Privacy & Security

Your privacy matters. Our Privacy Policy https://rentlynk.co.ke/privacy-policy explains:

  • What data we collect
  • How we use and protect it
  • Your rights regarding your personal information

We use encryption (256-bit SSL/TLS) to protect your data in transit and at rest.

9. Intellectual Property

  • All content on the Platform (logos, code, designs, text, graphics) is owned by RentLynk or its licensors.
  • You may not copy, modify, distribute, or reverse-engineer any part of the Platform without written permission.
  • You retain ownership of the data you upload (tenant lists, lease documents, etc.). We do not claim ownership of your content.

10. Limitation of Liability

To the maximum extent permitted by Kenyan law:

  • RentLynk is provided "as is" and "as available".
  • We do not guarantee that the Platform will be uninterrupted, error-free, or secure at all times.
  • We are not liable for any indirect, incidental, or consequential damages (e.g., lost rent, lost profits) arising from your use of the Platform.
  • Our total liability to you for any claim shall not exceed the total fees paid by you to RentLynk in the 3 months preceding the claim.

11. Disclaimer of Warranties

RentLynk makes no warranties regarding:

  • The timeliness of payments from tenants
  • The accuracy of third-party payment processor operations (M-Pesa, banks, etc.)
  • The outcome of any dispute between Landlord and Tenant

We recommend that Landlords maintain their own lease agreements and follow Kenyan tenancy laws (e.g., Landlord and Tenant (Shops, Hotels and Catering Establishments) Act, Rent Restriction Act).

12. Indemnification

You agree to indemnify and hold RentLynk, its directors, employees, and partners harmless from any claims, losses, damages, or expenses (including legal fees) arising from:

  • Your violation of these Terms
  • Your misuse of the Platform
  • Your dispute with a tenant or landlord
  • Your violation of any Kenyan law or third-party rights

13. Termination

13.1 By You

You may delete your account at any time via settings or by contacting support@rentlynk.co.ke.

13.2 By Us

We may suspend or terminate your account if you violate these Terms, engage in fraud, or pose a security risk.

13.3 Effect of Termination

Upon termination:

  • You lose access to your account and data.
  • Any pending withdrawals will be processed within 7 business days.
  • We may retain certain data as required by Kenyan law (e.g., financial records for 7 years per the Tax Procedures Act).

14. Dispute Resolution & Governing Law

14.1 Governing Law

These Terms are governed by the laws of the Republic of Kenya.

14.2 Informal Resolution

If a dispute arises, contact us first at support@rentlynk.co.ke. We will attempt to resolve the issue amicably within 14 days.

14.3 Formal Resolution

If informal resolution fails, the dispute shall be referred to binding arbitration in Nairobi, Kenya, under the Arbitration Act (Cap 49) . Either party may appeal to the High Court of Kenya if permitted by law.

15. Amendments

We may update these Terms from time to time. We will notify you via:

  • Email to your registered address
  • In-app notification
  • A notice on our website

Continued use of the Platform after changes constitutes your acceptance of the revised Terms.

17. Miscellaneous

  • Severability: If any provision is found invalid, the remaining provisions remain in full force.
  • Waiver: Our failure to enforce a right does not waive that right.
  • Entire Agreement: These Terms constitute the entire agreement between you and RentLynk regarding your use of the Platform.
  • No Agency: Nothing in these Terms creates an agency, partnership, or employment relationship.

By using RentLynk, you acknowledge that you have read, understood, and agreed to these Terms of Use.
